Interesting question. Not being a trademark lawyer, I don’t know the answer. I’m guessing as a layman that the town if it has proper trademark filings approved, has a legal claim. Artist’s interpretations of a private building sold as an original, not as prints, may be protected. You need a professional legal opinion before you advise artists. If a painter paints a private building and sells the artwork – are they somehow in danger of infringement? I work for a famous town that has lawyers representing the trademark and word mark throughout the town. Recently, I have been charged with task of letting all the local artists who are painting our famous landmarks and selling them – that they are infringing on our word mark and trademark. I understand trademark and word mark of the name of the town and some of its stores, but I can’t wrap my head around an artists interpretation of our buildings being an infringement (but they are selling this art). I would love to have third-party perspective. Hopefully you can guide me so I may be able to make a stance for the artists. If not, I will at least know I am doing the right thing by telling them the law says this: THANK YOU FOR YOUR HELP IN ADVANCE.
